Privacy Notice

1. Scope and consent
This Privacy Notice describes how Equip Place ("Equip Place," "we," "us") collects, uses, discloses, retains, and protects information when you visit our website, create an account, list or browse equipment, contact a dealer, submit an offer or inquiry, apply for financing, request a shipping quote, post in the community, or otherwise interact with us (the "Platform"). It is part of, and incorporated into, our Terms of Use.
By using the Platform or submitting information to us, you consent to the collection, use, sharing, and communications described here. If you do not agree, do not use the Platform.
2. Information we collect
Information you provide. Name, business or dealership name, email address, phone number, mailing address or city/state/ZIP, account credentials, profile and storefront content, listing details, photos and videos you upload, messages, offers, questions and answers, reviews, community posts, contact and inquiry forms, financing application details (which may include business and financial information you choose to submit), shipping request details, advertising requests, and support correspondence.
Payment information. Dealer subscription and advertising payments are handled by our payment processor. We receive limited billing details such as plan, status, last four digits, and transaction records; we do not store full card numbers.
Automatically collected information. IP address, approximate location derived from IP or ZIP, device and browser type, operating system, referring and exit pages, pages and listings viewed, search terms and filters, clicks, view counts, session timing, crash and diagnostic data, and similar analytics data collected through cookies, pixels, local storage, and server logs.
Information from others. Data from dealers, sellers, verification and identity sources, financing and transport partners, advertising and analytics providers, and publicly available sources, including equipment specification and market data.
Sensitive information. We do not seek government ID numbers, financial account numbers, or other sensitive personal information through the Platform; please do not submit it in free-text fields or uploads.
3. How we use information
- Create and administer accounts, storefronts and listings, and authenticate users.
- Connect buyers and sellers, route leads, deliver messages, offers, inquiries and alerts.
- Operate features such as watchlists, saved searches, machine alerts, comparisons, price and confidence scores, recommendations, community answers, and the AI equipment expert.
- Process payments, subscriptions and advertising, and issue receipts and billing notices.
- Forward financing applications, shipping requests, and seller submissions to the dealers, lenders, brokers or transport providers needed to fulfill your request.
- Send service, transactional and administrative communications, and — where permitted — marketing.
- Measure, analyze and improve the Platform, develop new features, and train or tune internal ranking, matching and quality systems using aggregated or de-identified data.
- Prevent fraud, abuse, spam and security incidents; enforce our Terms; and establish, exercise or defend legal claims.
- Comply with law, regulation, subpoena, court order, or lawful government request.
Our legal bases, where applicable, are performance of a contract, our legitimate interests in operating and securing a marketplace, your consent, and compliance with legal obligations.
4. Email, SMS and other communications
When you give us your email address or phone number — by registering, contacting a dealer, submitting an inquiry, applying for financing, requesting a quote, creating an alert, or writing to us — you agree that we, and the dealers or partners handling your request, may contact you at that address or number about the Platform and about the equipment or service you inquired about.
Service messages (account, security, password reset, offers, messages, alerts, billing, policy updates, and responses to your requests) are required for the service and are not marketing; you cannot opt out of them while you hold an account, though you may close your account.
Marketing messages (newsletters, featured inventory, promotions, dealer offers, product announcements) may be sent where permitted by law. You can opt out at any time using the unsubscribe link in the message or by contacting us; we will honor it promptly, and it will not affect service messages.
If you provide a phone number, you consent to calls and text messages, including autodialed or prerecorded messages where permitted, from us and from the dealers or providers you contacted, at the number given. Consent is not a condition of purchase. Message and data rates may apply. Reply STOP to opt out of texts. Calls and messages may be monitored or recorded for quality, training and record-keeping where permitted.
7. Your privacy rights and choices
Depending on where you live, you may have rights to access, correct, delete, or receive a copy of your personal information, to opt out of targeted advertising and the sale or sharing of personal information, to limit use of sensitive data, and to appeal a denial — including under the CCPA/CPRA and similar state laws, and, where applicable, the GDPR or UK GDPR (which also include rights to object, restrict, withdraw consent, and complain to a supervisory authority).
You can update most account details in your profile, remove your own listings and posts, unsubscribe from marketing, and request deletion of your account. To exercise a right, use our contact page. We will verify your identity before responding and will not discriminate against you for exercising a right. An authorized agent may submit a request with proof of authority. Some data must be retained for legal, security, tax, fraud-prevention, or transaction-record purposes.
8. Retention and security
We keep personal information for as long as your account is active and afterward as needed to provide the service, resolve disputes, enforce agreements, and meet legal, accounting, tax and security obligations, after which we delete or de-identify it. Public content and transaction records may persist after account closure.
We use reasonable administrative, technical and physical safeguards, including encryption in transit and access controls. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for keeping your password confidential and for information you choose to disclose to other users.
9. Children
The Platform is for business and adult use and is not directed to children under 18. We do not knowingly collect personal information from children under 13 (or under 16 where applicable). If we learn we have, we will delete it. Contact us if you believe a child provided us information.
10. Third-party sites and international users
The Platform links to third-party websites, dealer sites, payment pages and services we do not control. Their privacy practices govern the information you provide to them; review their notices.
We operate in the United States. If you access the Platform from outside the U.S., you understand your information will be transferred to, stored and processed in the United States and other countries whose data protection laws may differ from your own, and you consent to that transfer.
11. Changes and contact
We may update this Privacy Notice at any time. Material changes will be posted here with a new effective date, and continued use of the Platform after posting means you accept the updated notice.
